Chief Justice Martha Koome of Kenya has selected a three-judge bench to handle the legal challenge against the Finance Act 2023.
The bench, led by High Court Judge David Majanja, will also include Justice Lawrence Mogambi and Justice Christine Meoli.
The next step for the newly formed bench is to determine a hearing date for the case.
The Finance Act 2023 encountered legal obstacles after Justice Mugure Thande issued a conservatory order on June 30, effectively suspending its implementation on a temporary basis.
Designed to generate an additional Sh211.0 billion in tax revenue during the 2023/24 financial year, the Act’s fate remains uncertain.
On July 10, 2023, Justice Thande declined to lift the conservatory orders and transferred the case to the Chief Justice for the formation of a dedicated bench to address the petition.
