The High Court has suspend the state’s decision to lease certain berths at the ports of Mombasa and Lamu County to private investors.
The suspension order on the privatizing of berths 16-18 at Container Terminal 2 of Mombasa Port and recently constructed Lamu berths, is effective until December 6, where the court reconvene.
The case was filed by a group identifying themselves the Taireni Association of Multimedia, who argue that the Kenya Ports Authority (KPA) lacks the legal authority to dispose of public assets.
The association further claims that the entire process is marred by irregularities, calling for the protection of public assets and investments.
Justice Chacha Mwita, overseeing the case, directed prompt service of pleadings to the respondents, including the CS Treasury, CS Transport, the Attorney General, and the Kenya Ports Authority.
The court reconvention on December 6 will provide further directions on the matter.
