The High Court has declared the appointment of Anthony Mwaura as Chairman of the Kenya Revenue Authority (KRA) Board illegal and unconstitutional.
High Court judge Francis Gikonyo revoked Mwaura’s appointment, emphasizing that it failed to uphold national values and integrity as required by the constitution.
The judge highlighted concerns over Mwaura’s unresolved criminal charges, including allegations of corruption and economic crimes, which he noted as critical factors in assessing integrity for public office.
Judge Gikonyo emphasized the importance of public trust in governance, stating that Mwaura’s appointment was inconsistent with these principles.
“The appointment of a person facing serious criminal charges undermines the public’s confidence in leadership,” Judge Gikonyo remarked, dismissing Mwaura’s defense that no legal barrier existed at the time of his appointment.
The ruling, supported by petitioner Dr. Benjamin Gikenyi, stressed the need for adherence to national values and governance principles outlined in Article 10 of the constitution.
